Two reasons;

1. When I first started ordering TS shirts a few years back I was a bit smaller and the 40's fit me

2. Some of the 40's I have are sewn up larger than others so some of them actually still fit me in most areas...it's a more slim fit but they still fit. some of these might actually work for you and I can give you the measurements of the ones you are interested in. Off the top of my head I do remember the Charcoal Oxford sewing up a bit large for a 40.
